South Korea's AI Law Is Ten Weeks Old. Every European Financial Services Firm Should Be Paying Attention.

The law makes South Korea only the second jurisdiction worldwide, after the EU, to operate a comprehensive, AI-specific regulatory framework. Unlike the EU AI Act's four-tier, risk-based structure, Seoul's approach collapsed 19 separate regulatory proposals into a single regime with one critical feature that should unsettle every European financial institution with Korean operations: explicit extraterritorial reach.
Ten weeks in, the picture is clear. Compliance is not optional, enforcement is approaching, and South Korea's Ministry of Science and ICT (MSIT) is moving quickly to finalise the implementation decrees that will determine exactly how hard the rules bite.

What the Law Actually Does
The AI Basic Act's scope is deliberately broad. It captures foreign providers if they meet any one of three thresholds: KRW 1 trillion in total global revenue, KRW 10 billion in AI service revenue generated in Korea, or 1 million average daily domestic users. Most major AI platforms already clear at least one of these bars, meaning the law applied to them from day one.
Compliance obligations fall into three distinct categories. Generative AI systems must notify users that a product is AI-powered, label AI-generated outputs, and comply with deepfake labelling requirements. High-impact AI deployed in public decision-making, healthcare, transport, energy, nuclear operations, and credit decisions faces considerably stricter obligations: pre-deployment impact assessments, risk evaluation, mandatory human oversight, user notifications, and continuous monitoring. Systems that consumed more than 10 to the power of 26 floating-point operations during training must conduct and document risk mitigation assessments.
The penalties are meaningful: administrative fines reach up to KRW 30 million per violation, and reputational damage in a market where corporate governance is closely scrutinised by regulators and consumers alike adds a further deterrent. For European banks and asset managers operating credit-scoring or algorithmic lending tools in South Korea, the high-impact category is the one that demands immediate attention.
Why European Financial Services Firms Are Directly in Scope
Credit decision systems are explicitly named in the high-impact category. Any European financial institution using a large language model, a foundation model, or an automated underwriting tool to serve Korean retail or corporate clients must now conduct pre-deployment impact assessments and document human oversight protocols before those systems go live. Firms that were already live on 22 January 2026 are operating under the law as written, with no grace period for existing deployments.

How Global AI Providers Are Responding
Internally, compliance teams at firms including Anthropic and OpenAI are mapping exposure across Korean enterprise deployments. Foundation model providers pitching to Korean banks, insurers, and healthcare organisations are now marketing compliance-by-design architectures as a differentiator. The enforcement timeline remains partially unclear because the MSIT has not yet published finalised implementation decrees, which creates a narrow window for companies filing formal comments during the rule-making process to influence how specific obligations are interpreted.
The three most consequential ambiguities are these. First, what exactly constitutes high-impact AI within credit markets? The law names the sector but does not codify granular thresholds distinguishing a fully automated credit decision from a human-assisted recommendation tool. Second, what does mandatory human oversight actually require? The law does not specify whether regulators expect a human-in-the-loop veto before each decision, periodic human review of model outputs, or continuous real-time monitoring. Third, how broadly will deepfake labelling apply? Will it cover only synthetic media mimicking identifiable individuals, or any AI-generated image, video, or audio regardless of subject matter?
These ambiguities are costly for foreign investors planning Korean operations and create a regulatory holding pattern for domestic players. The MSIT has publicly committed to transparent oversight, and most observers expect substantive implementation guidance before the end of Q2 2026. Until that guidance arrives, the law applies as written, and delayed clarity is not a compliance excuse.
