Security Vulnerabilities Cast Long Shadows

European Regulatory Implications
Unlike markets where AI workplace surveillance exists in a relative regulatory vacuum, the EU and UK present a layered and increasingly assertive compliance landscape. The EU AI Act, which entered into force in August 2024, classifies systems used for evaluating the behaviour or personality traits of natural persons in employment contexts as high-risk. That classification carries mandatory conformity assessments, transparency obligations, and human oversight requirements.
Andrea Glorioso, the European Commission's former digital attaché and a senior figure in EU AI policy discussions, has noted that the Act was specifically designed to prevent the normalisation of opaque scoring systems in workplaces. Under its provisions, employers deploying such systems must inform workers, ensure meaningful human review of AI-generated assessments, and maintain detailed documentation of system accuracy and bias testing.
The accuracy question is not trivial. Burger King has not released quantitative performance data for Patty's speech recognition, leaving uncertainty about how the system handles the linguistic diversity typical of European workforces. A Burger King outlet in Birmingham, Brussels, or Barcelona will employ staff speaking with a wide range of accents and potentially switching between languages mid-conversation. Algorithmic systems trained predominantly on American English voice data carry a well-documented risk of systematically misclassifying non-native speakers, which could constitute indirect discrimination under EU employment law.
What Workers Are Actually Saying
Employee reaction has been overwhelmingly critical, with online discussions frequently describing the system as 'dystopian'. Workers argue that genuine improvements in customer service would come from better wages and working conditions rather than AI-powered manner monitoring. Key concerns include the following:

How Patty Compares to Traditional Monitoring

Canada is scheduled to receive similar AI voice coaching capabilities in 2026. European rollout timelines have not been announced, but Restaurant Brands International's global footprint makes expansion to EU and UK markets a matter of when rather than whether. When that moment comes, the company will face a regulatory environment substantially more demanding than anything it has encountered in North America.
The Information Commissioner's Office has already signalled heightened scrutiny of always-listening workplace devices following several high-profile enforcement actions in the logistics and retail sectors. Any European deployment of Patty would require a data protection impact assessment, clear legal bases for processing biometric-adjacent voice data, and demonstrably fair mechanisms for workers to contest AI-generated assessments.
The broader question is not whether AI can monitor friendliness. It plainly can. The question is whether it should, and on whose terms. For European workers, the answer will increasingly be shaped by regulation rather than corporate discretion.
