Europe did not invent rights-based AI governance, and Latin America is proving it. Across the Atlantic, governments from Brazil to Chile are building regulatory frameworks that place citizen welfare, algorithmic fairness, and democratic integrity ahead of speed-to-market, and the results are forcing a reassessment of how the EU and UK approach their own fast-evolving AI policy landscape.
A Rights-Centred Model Takes Shape
The core proposition in Latin America is straightforward: AI governance must be anchored in fundamental human rights, not retrofitted with rights considerations after economic and security priorities have already been locked in. That distinction matters enormously, and it maps directly onto a debate currently live inside the European Commission and within the UK's AI Safety Institute.
The region's approach rests on several non-negotiable pillars: transparency in algorithmic decision-making, meaningful individual control over personal data, enforceable accountability mechanisms, and active protection against AI-amplified discrimination. These are not aspirational talking points. They are being written into procurement rules, public-sector deployment conditions, and cross-border cooperation agreements.
The parallels with Europe's AI Act are obvious, but the differences are instructive. Where Brussels has structured its regulation around risk tiers and use-case categories, Latin American frameworks lead with the rights holder rather than the technology. That framing shift changes which questions get asked first and which trade-offs are treated as acceptable.

What European Policymakers Are Saying
Dragos Tudorache, the Romanian MEP who co-led the European Parliament's negotiations on the AI Act, has consistently argued that the Act's real value lies not in its prohibited-use lists but in its fundamental rights impact assessments, a point that aligns closely with the Latin American approach. Speaking at a Bruegel Institute event in Brussels earlier this year, he stressed that rights-based framing must be embedded at the design stage, not added as a compliance checkbox after deployment decisions are made.
Equally relevant is the position of Margrethe Vestager, the European Commission's former Executive Vice-President for digital affairs, who repeatedly argued during her tenure that algorithmic accountability and democratic integrity are inseparable. Her framework for platform regulation drew on similar instincts to those now visible in Latin American AI governance: start with the citizen, build the technology rules outward from there.
Multi-Stakeholder Governance: The Process Matters as Much as the Outcome
One of the most transferable aspects of the Latin American model is its insistence on inclusive policy formation. Rather than relying on expert-led regulatory drafting followed by a brief public consultation, countries such as Chile and Colombia have used systematic, structured multi-stakeholder processes that give civil society organisations, academics, and private-sector representatives genuine influence over framework design.
This collaborative model reflects democratic traditions and produces frameworks that are more durable because they carry broader legitimacy. The contrast with some EU member-state approaches, where AI policy has been driven almost entirely by economic ministries or industry lobbying, is stark.
Key governance priorities that the Latin American model emphasises, and that European implementers should benchmark against, include:
- Building technical expertise within government agencies responsible for AI oversight, rather than outsourcing that capacity entirely to regulated firms
- Establishing clear accountability mechanisms for algorithmic decision-making in public services, including healthcare, benefits assessment, and criminal justice
- Creating citizen-accessible processes for challenging AI-driven decisions, with meaningful remedies rather than symbolic rights
- Developing cross-border cooperation frameworks for data governance that do not simply replicate national silos at regional level
- Investing in digital literacy programmes that enable informed public participation in democratic oversight of AI systems
Implementation Challenges That Europe Recognises
Latin America is candid about the gap between principled frameworks and practical enforcement. Regulatory bodies remain underfunded and technically outgunned relative to the firms they oversee. Digital literacy gaps mean that citizens cannot always exercise the rights that frameworks nominally guarantee. And the tension between innovation incentives and protective regulation is as live in Bogota as it is in Berlin.
Europe faces analogous pressures. The AI Act's implementation timeline is aggressive, several member states lack the institutional infrastructure to conduct meaningful conformity assessments on high-risk systems, and the UK's post-Brexit approach, which has deliberately avoided a single binding AI statute in favour of sector-by-sector guidance, creates its own enforcement fragmentation.
The honest lesson from Latin America is not that rights-based frameworks solve these problems automatically. It is that naming rights as the primary organising principle disciplines every subsequent trade-off. When enforcement budgets are tight, you protect rights first. When innovation and protection conflict, the framework tells you which way to lean.
AI for Public Good Within Rights Constraints
Critically, Latin American experience shows that rights-based constraints do not prevent beneficial AI deployment. Healthcare diagnostics, disaster response coordination, urban planning, and educational access have all seen effective AI applications in Brazil, Colombia, and Argentina, all operating within frameworks that mandate privacy protection and explainability.
This matters for the European debate, where a recurring industry argument holds that rights-based or precautionary regulation will stifle innovation and cede ground to less regulated competitors. The Latin American evidence does not support that argument. Colombia and Argentina in particular have demonstrated AI-driven improvements in emergency response that maintained citizen privacy while delivering measurable operational gains.
Public-good applications that have succeeded under rights-based governance include healthcare diagnostic tools with explainable outputs and patient consent controls, environmental monitoring systems built on open-data principles, and educational technology platforms designed with accessibility and equity as primary specifications rather than afterthoughts.
Regional Cooperation as a Model for EU-UK Coordination
Latin America's cross-border cooperation mechanisms, facilitated by regional development institutions, offer a template that is directly relevant to the EU-UK AI governance relationship post-Brexit. The two jurisdictions share foundational values, overlapping regulatory objectives, and significant mutual economic exposure in AI-intensive sectors. Yet the current arrangement involves parallel regulatory processes with limited formal coordination.
A structured knowledge-exchange mechanism, modelled on the kind of technical assistance programmes that Latin American countries use to help smaller nations adopt proven governance solutions, could reduce duplication and improve policy quality on both sides of the Channel. It would also send a signal to global partners that democratic, rights-based AI governance is not a competitive disadvantage but a shared strategic asset.
