Australia has made a clear regulatory choice: rather than replicate the EU AI Act, it is embedding artificial intelligence oversight into established consumer protection, privacy, and liability law. For European policymakers already grappling with the cost and complexity of their own landmark legislation, that choice deserves serious scrutiny, not dismissal.
Integration Over Isolation
The Australian strategy rests on a simple premise. Existing legal frameworks already govern safety, accountability, and data handling. Rather than constructing a parallel architecture, regulators are amending those structures to capture AI-specific risks. The Australian Competition and Consumer Commission is sharpening its enforcement teeth through product design accountability provisions, extending the same muscular approach it applies to physical goods to algorithmic systems.
This contrasts sharply with the EU's comprehensive, tiered AI Act, which entered force in August 2024 and imposes obligations ranging from transparency requirements on general-purpose models to outright prohibitions on certain high-risk applications. The EU approach offers regulatory certainty but carries a substantial compliance overhead, particularly for smaller firms and public sector bodies.
Margrethe Vestager, in her final months as European Commission Executive Vice-President for A Europe Fit for the Digital Age, consistently argued that the AI Act's risk-based architecture would protect citizens without strangling innovation. That argument is now being tested in practice, and Australia's parallel experiment offers a useful counterfactual.

Mandatory Safety Standards: A Familiar Playbook
The cornerstone of Australia's framework is mandatory safety standards for high-risk applications, introduced through amendments to consumer protection law rather than bespoke AI statutes. Healthcare AI faces the strictest requirements; autonomous systems receive the highest level of scrutiny; recommendation algorithms occupy a lighter tier. The logic mirrors the EU's own risk-based categorisation, even if the legal vehicle differs.
What makes this notable for a European audience is enforcement posture. Australia's competition regulator has signalled it will treat AI safety failures the same way it treats defective products: with significant financial penalties and reputational consequences for developers and operators alike. That is a message European national competent authorities, currently being designated under the AI Act, would do well to internalise. Regulatory credibility depends on enforcement, not legislation alone.
Philipp Hacker, Professor of Law and Ethics of the Digital Society at the European University Viadrina and a contributor to EU AI policy debates, has argued that the AI Act's effectiveness will hinge on whether national enforcement bodies have adequate resources and genuine appetite to act. Australia's approach sidesteps the resourcing problem by routing enforcement through an already-funded, battle-tested agency.
Privacy as the Second Pillar
Australia is also strengthening its Privacy Act to address AI-specific data challenges: collection practices unique to machine learning pipelines, opaque usage of training data, and storage obligations that existing provisions did not anticipate. Users must understand how their data influences AI outputs, particularly in sensitive contexts such as credit scoring and employment screening.
European observers will recognise the ambition. The General Data Protection Regulation already imposes transparency and purpose-limitation obligations that apply to automated decision-making, and Article 22 gives individuals the right not to be subject to solely automated decisions with significant effects. In practice, enforcement has been uneven. Ireland's Data Protection Commission, responsible for regulating many of the world's largest AI-deploying platforms by virtue of their EU headquarters, has faced sustained criticism for the pace of its investigations.
The Australian model consolidates privacy enforcement within a strengthened single framework rather than relying on sectoral regulators to interpret general-purpose data protection rules. Whether that consolidation produces faster, more consistent outcomes is the key empirical question.
Liability: Extending What Already Works
Australia's third pillar extends existing negligence and product liability principles to cover algorithmic decision-making. When an AI system causes harm, there is a defined chain of accountability: manufacturer liability, operator responsibility, or hybrid models depending on the deployment context. Victims have clear redress avenues without needing to navigate a new statutory regime.
This is arguably the area where European law remains least settled. The EU's revised Product Liability Directive, updated in 2024 to explicitly cover AI-enabled products, and the proposed AI Liability Directive, still working through the legislative process, attempt to fill the same gap. However, the interaction between those instruments and the AI Act's own enforcement mechanisms has not been fully resolved, creating potential overlap and confusion for claimants.
Nicolas Moës, Director of European AI Policy at The Future Society in Brussels, has noted that liability clarity is consistently cited by European businesses as a top compliance concern, ranking alongside conformity assessment costs and audit requirements. Australia's decision to route liability through established tort and product law, rather than create a new cause of action, addresses that concern directly.
Implementation Priorities and the Capacity Question
Australia's rolling implementation schedule includes five core priorities that translate directly into European policy language:
- AI literacy programmes for businesses and regulatory staff, building practical understanding of system capabilities and risks.
- Ethical AI research funding to support responsible development practices across sectors.
- Public dialogue initiatives to shape societal expectations around AI deployment.
- International cooperation frameworks to align with partners whilst maintaining regulatory sovereignty.
- Capacity building targeted specifically at small and medium enterprises facing disproportionate compliance burdens.
That last point deserves emphasis in the European context. The AI Act's conformity assessment and technical documentation requirements impose fixed costs that large firms can absorb far more easily than start-ups or mid-market companies. The European Commission's AI Office has acknowledged this and is developing guidance to assist smaller operators, but concrete support mechanisms remain limited. Australia's explicit SME focus is a structural commitment, not an afterthought.
A government-wide AI capability assessment is also scheduled for late 2026, evaluating how public agencies themselves deploy AI tools. The logic is sound: regulators who understand AI in practice are better placed to regulate it. Several EU member states, including Germany through its Agentur für Innovation in der Cybersicherheit and France through its investment in Mistral AI as a sovereign model provider, are building internal AI capability. But a coordinated, cross-government audit of this kind has no direct European equivalent yet.
The Comparison That Matters
Set out plainly, the contrast between the Australian and European approaches looks like this:

Neither model is obviously superior. The EU's approach provides a single, comprehensive reference point that simplifies cross-border compliance for firms operating across multiple member states. Australia's approach is faster to adapt but depends heavily on consistent judicial and regulatory interpretation of stretched existing provisions.
What Australia demonstrates is that a credible alternative exists. The assumption that effective AI governance requires bespoke primary legislation is a political choice, not a technical necessity. European policymakers would benefit from monitoring Australian implementation data closely, particularly enforcement outcomes and compliance cost benchmarks, before concluding that the EU AI Act's architecture is the only viable template for democratic governance of AI.
